Appellate Cases

Modrall Sperling regularly handles appeals in all appellate courts of the State of New Mexico, the Tenth Circuit Court of Appeals and the United States Supreme Court, and we handle or assist on appeals in selected areas in state and federal appellate courts across the nation. In addition, the firm regularly handles federal, state and local administrative appeals. Although past successes cannot be an assurance of future success, we have successfully prosecuted and defended appeals of cases we have handled through judgment, as well as interlocutory appeals and applications for extraordinary writs. We are also often called on for the first time to consult on or assume responsibility for matters after they have reached the appellate stage of the litigation. Firm attorneys have also filed numerous briefs for the New Mexico Defense Lawyers Association, industry, and other groups as amicus curiae.

Offering Support Through the Appellate Process

While the individual trial lawyer who handled a case in its trial stage usually retains his or her role as lead counsel for the appeal, the firm’s Appellate Review Committee provides support through the appellate process.
