Employment and Labor

Modrall Sperling's employment and labor law attorneys believe effective representation requires a clear understanding of a client's business and objectives as well as knowledge of federal and New Mexico employment and labor laws. Our goal is to understand a client's business and objectives so that we can efficiently apply our knowledge and experience to a client's employment-related problems.

Advising Public and Private Employers

Modrall Sperling advises public and private employers in New Mexico and elsewhere on many employment-related issues, such as conducting internal investigations, taking and documenting disciplinary action, reductions in force, drug testing, compliance with wage and hour laws, covenants not to compete, trade secrets and confidentiality/proprietary information agreements, personnel policies, affirmative action obligations, and collective bargaining.

Representing Clients in Federal and New Mexico Employment Lawsuits

We also represent the firm's clients in all types of federal and New Mexico employment lawsuits, including cases involving claims of employment discrimination, retaliatory discharge, breach of contract, sexual harassment, unemployment benefits, wage and hour, workers' compensation, non-competition and trade secrets agreements, and collateral tort claims such as defamation, interference with economic relations, infliction of emotional distress, and invasion of privacy. We also counsel our clients through administrative audits, investigations, and informal inquiries.

Working Together for Maximum Effectiveness

Modrall Sperling's employment and labor lawyers also regularly work with the firm's other attorneys to provide our clients with the full resources of one of the largest law firms in New Mexico. For example, they have worked closely with firm Indian law practitioners to advise clients how to comply with federal and tribal employment laws while doing business on or near Indian lands, as well as with the firm's environmental lawyers to defend an environmental whistleblower action using an on-line library compiled for the use of the Department of Labor's Administrative Law Judges. They also work regularly with the firm's Employee Benefits and ERISA lawyers to offer our clients a full range of employment-related legal services. Increasingly, the firm's employment law litigators also work with our intellectual property lawyers on matters relating to non-competition, trade secrets and proprietary information issues.
