Litigation & Regulatory Matters

Our attorneys have substantial experience in defending healthcare entities against personal injury lawsuits, ERISA/employee benefits claims, qui tam actions, defending manufacturers and suppliers in medical device and pharmaceutical products liability negligence litigation, and various other proceedings before trial and appellate courts, regulatory bodies and law enforcement agencies. The firm regularly represents healthcare and other clients in forming business corporations, professional corporations, partnerships and limited liability companies and in structuring their transactions to minimize tax liability. We have represented clients in public finance, real estate and asset based secured transactions throughout the State of New Mexico and assist clients to negotiate, structure and document transactions involving the purchase, sale, exchange, development, leasing and financing of commercial real estate.

Compliance

Our lawyers can also assist providers in drafting and implementing corporate compliance programs and with other compliance activities to minimize risk in the areas of privacy, Medicare and Medicaid fraud and abuse, and HIPAA compliance. We regularly counsel clients with respect to the intricacies of compliance with the federal Stark Law and Anti-Kickback and Antitrust Statutes. We also have represented healthcare clients with respect to compliance issues before various government agencies.
