Since its inception, Modrall Sperling has had a significant litigation practice. Litigation sometimes proves the only effective way to preserve a client's rights. While we have substantial experience with alternative dispute resolution and other means to resolve disputes, we have the expertise and resources necessary to aggressively litigate cases when appropriate.

Our Wealth Of Experience

The firm's attorneys have a wealth of background in litigation. Our more senior litigators have been trying cases for well over 30 years and have been involved in some of the most significant litigation in New Mexico. In addition, a number of our attorneys have joined us after completing judicial clerkships with various state and federal courts.

Modrall Sperling is regularly involved in litigation in New Mexico's thirteen State District Courts. We have also been involved in specific kinds of litigation (for example, oil and gas, Indian law, products liability) in cases in courts in other states, or with a national focus.

Our Range Of Representation

Federal Courts
Modrall Sperling's attorneys regularly appear in federal court, both in the United States District Court for the District of New Mexico, the Tenth Circuit Court of Appeals and elsewhere. Members of the firm also have represented clients in a variety of Indian tribal courts in New Mexico and elsewhere.

Appellate Practice
Modrall Sperling engages in a significant appellate practice in state, tribal, and federal courts, and our lawyers have handled cases before the United States Supreme Court.

Administrative Litigation
Our administrative litigation practice is also very active, and we handle a variety of administrative proceedings, ranging from administrative litigation regarding state and local taxation to responding to inquires from the Equal Employment Opportunity Commission, to hearings over environmental and mining permits.

Complex Litigation
The firm regularly handles complex litigation involving multiple parties, class actions, and/or multi-district litigation, including one of the largest antitrust cases in New Mexico's history and a number of products liability cases involving national issues (breast implants, diet drugs, asbestos, tobacco). Where appropriate, our litigation attorneys make active use of litigation support and presentation technology to enhance our services.
