Mining

Modrall Sperling has long represented large and small mining companies and investors in mineral properties throughout the West. Our continuing goal is to help our clients be effective and efficient in meeting their often complex and difficult business, regulatory and litigation challenges. We rely not only on the firm's long-standing training and experience in mining law, but also on attorneys from other parts of the firm who bring their knowledge to bear on particular clients' needs and concerns. As the need arises, we also work with a broad range of experts and consultants who may form part of a team on any particular matter.

Our Range of Representation

Our extensive mining and minerals experience includes representation relating to coal, hardrock, precious metals, energy fuels, construction aggregates and specialty minerals. We represent clients in a wide range of mining and milling matters including leasing, joint ventures, like-kind exchanges of mineral properties, mergers and acquisitions, mineral development on private, public and Indian lands, claim staking and location, conveyancing, and environmental and non-environmental regulatory permitting and compliance.

Litigation Experience

We also prosecute administrative appeals in connection with such matters as regulatory enforcement actions, royalty valuations, and tax assessments. Our litigation experience includes disputes over mining and processing contracts, antitrust issues, ownership of mineral properties, priority of mining claims, public lands access, mine reclamation, environmental remediation and the validity of mining leases.

Key Roles on Behalf of the Mining Industry

Our attorneys have also had key roles on behalf of the mining industry and have been instrumental in resolving disputes and negotiating with federal, state and tribal authorities in the development of legislation and regulations on a range of mining, environmental and procedural issues.
