Oil and Gas

Our oil and gas practice has been a mainstay of Modrall Sperling's natural resources practice since the early days of the firm. Over the years, some of the firm's largest and most complex litigation matters have arisen from disputes involving oil and gas contracts and interests. The firm's oil and gas clients include major and independent producers, pipelines and landowners.

Our Range Of Representation

We represent our oil and gas clients in all aspects of business transactions, taxation, real estate matters, agency proceedings, public and Indian lands development, torts and civil litigation. Our transactional experience includes review and drafting of agreements relating to the financing, development, operation and transfer of oil and gas properties, including operating agreements, unitization agreements, Indian mineral development agreements, liens, gas purchase contracts, and transportation contracts. We represent clients before state and federal administrative agencies charged with responsibility for royalty collection and the development of the state's oil and gas resources, including the New Mexico Oil Conservation Division, New Mexico Taxation and Revenue Department, Bureau of Land Management, Minerals Management Service, Bureau of Indian Affairs, and Interior Board of Land Appeals. We also provide advice regarding ownership and prepare title opinions.

Our Substantial Experience Representing Oil and Gas Developers and Pipelines

We have substantial experience representing oil and gas developers and pipelines in acquiring or defending rights in rights-of-way across federal, state, Indian, and fee lands. Our oil and gas attorneys also regularly represent clients involved in complex litigation, including cases concerning ownership disputes, royalty disputes, take-or-pay litigation, and environmental problems.
