At the state level, representing entities before the New Mexico utility regulatory commission - the Public Regulation Commission ("PRC") - is a significant area of Modrall Sperling's practice. Our attorneys are well-versed in New Mexico's electricity, natural gas, telecommunications, water, and utility legislation and procedures.

Representing Energy and Utility-related Clients

We have great depth of experience in matters such as location approval of new power plants, development of wind energy projects, transmission issues, rate treatment, and utility acquisition. We also have extensive background representing energy and utility-related clients before local governments, the New Mexico Environment Department and the State Land Office.

Federal Level Expertise

At the federal level, we have unique expertise at aiding clients in obtaining necessary permits from agencies such as the EPA and Army Corps of Engineers. Modrall Sperling attorney Joan Drake was formerly with the Corps in Los Angeles and New England and has significant depth of experience in Clean Water Act permitting, enforcement resolution, and federal environmental compliance. In addition, our attorneys practice before and follow developments at the Federal Energy Regulatory Commission ("FERC") on energy-related issues. We also provide counsel regarding developments in Indian Country and on public lands. Our lawyers are active in the ABA's Environment, Energy and Resources Section and Rocky Mountain Mineral Law Foundation, and are members of the Energy Bar Association.
