Tenth Circuit Finds for Navajo Mine

On March 30, 2016, the United States Court of Appeals for the Tenth Circuit summarily concluded that claims by several environmental groups against the Office of Surface Mining (OSM) — claims that threatened the temporary shutdown of Navajo Mine operations — were constitutionally moot and that an adverse decision from the District of Colorado should be vacated.  This is a significant victory for the Navajo Nation, its subsidiary, the Navajo Transitional Energy Company (NTEC), which owns the Navajo Mine, and our client, BHP Billiton Mine Management Company, which operates the Navajo Mine on behalf of NTEC.
