Basic Guide to Appeals for Busy Trial Lawyers

Shareholder Emil Kiehne will co-present on the basics of preserving issues for appeal, with a focus on areas where waiver often happens, describing how to preserve issues in motions to dismiss, motions for summary judgment, motions in limine, motions for directed verdict, trial objections, jury instructions and the occasions when a post-trial motion may be necessary to preserve an issue. Also for discussion are the basics of the appellate process in New Mexico’s state courts and in the Tenth Circuit: the filing of a notice of appeal; supersedeas bonds in cases with money judgments; docketing statements and the calendaring process; and the timeline for submission to a panel, oral argument and decision.
